BedRater, LLC. and its subsidiaries and affiliates (collectively “BedRater”) are committed to respecting your privacy. We want to make your online and mobile experiences satisfying and safe. This Privacy Policy describes how we collect, use, disclose, store and otherwise process information through this website (“Site”) and our mobile applications (“mobile application” or “app”) (jointly, the “Services”). We will not use or share your information except as described in this Privacy Policy. This Policy also describes your choices about the collection and use of your information.

This Privacy Policy, together with our posted Terms & Conditions (“Terms”) governs our relationship and we urge you to read this Privacy Policy and the Terms and Conditions carefully. Registration – Create Account:

In order to register, you will need to share your email address. You have register as a user to access and make full use of our Services. Once you register, you will have an account with BedRater and a password to access that account. In order to create an account, you will need to provide your name, an optional photo and an optional city where you reside.
You may not use another person's account without permission and you may not use anyone else's password. You should keep your registration current and complete. You are responsible for maintaining the confidentiality of your account and password. Please also let us know if there is any unauthorized use of your account or password. We recommend that you always log out from your account at the end of a session with us to prevent other people from accessing your account without your permission.

Review – Rate a Bed:

In order to rate a bed, you will be required to choose the location of your stay, the bed comfort level and the mattress firmness level. You may, at your option, provide the dates for your stay, a review of the stay and any photos you wish to share with BedRater and our Users.

b. Information received from other sources:

BedRater may also collect information about you from other sources to help us correct or supplement our records, improve the quality or personalization of our service to you, and prevent or detect fraud. We work closely with third parties (for example, business partners, service providers, subcontractors, advertising networks, analytics providers, search information providers, fraud protection services) and may receive information about you from them.

c. Electronically collected information:

When you access our Services, certain information is automatically collected to enhance your user experience and ensure the functionality of our services. This includes your IP address, browser type, operating system, device information, and other technical details. We may also gather information about your interactions with our website or application, such as the pages you visit, the features you use, and the duration of your sessions.

We may collect technical information about visitors to our Services (“Online User Activity”), through cookies and other technology. We, our service providers, and our business partners, may employ cookies and the other technologies described below to remember you when you return to our Services (or keep you logged in), collect information about how our Services are used, review website traffic patterns and improve the Services, and determine what Services are popular. We can also use such information to deliver customized content and advertising to users of the Services whose behavior indicates that they have particular interests.

d. Cookies

Cookies are a commonly used web technology that allow websites to store and retrieve certain information on a user’s browser, and track certain online activities. Clear GIFs (also called “pixels”, “web bugs” or “web beacons”) are small transparent images placed on a web page or in an email message to monitor user behavior, deliver cookies, collect information, count visits, understand usage and campaign effectiveness and detect if a recipient has opened and acted upon an email. Other such technologies include Local Storage Objects (LSOs) which can store content information and preferences on a user device, and Software Development Kits (SDKs) from vendors or service providers may be embedded in our apps to provide various functionality, including an ability to collect information about user activity. Finally, our Services maintain network and system logs of activity on our Services and provide another way for us to gather statistics about users’ browsing habits, such as how many and how often users have accessed or used our Services, which pages were visited and other similar data.

Usage Details about interactions with our Services (such as the date, time, and length of visits, and specific pages or content accessed during the visits, search terms, frequency of the visits, referring website addresses);
Device Information including the IP address and other details of a device that you use to connect with our Services (such as device type and unique device identifier, operating system, browser type, and mobile network information).

We may collect and use information that does not personally identify you, or has been anonymized or de-identified so it no longer identifies you. Such information is outside the scope of this Privacy Policy.

2. How we use the information we collect

We use the information we collect from you for the following purposes, as permitted by law:

To provide our Services to you (including account management, and preferences) and respond to communications;
To communicate marketing offers with you via email, mail or push notifications;
Operate, evaluate, and improve our Services for you and our other customers, including to diagnose or fix technology problems;
Monitor the performance of our Services including metrics such as total number of visitors, traffic, and demographic patterns, as well as analyze and enhance our communications and strategies;

3. How long we keep your information

The length of time that we keep information that pertains to you depends upon the data class in which the data is obtained. We generally delete your information after you delete your account, unless a retention of information such as username and email is necessary to improve our Services. We will maintain some information that we collect for longer periods where we need it to provide our products and services, comply with legal obligations or protect our or other interests. We decide how long we need information on a case-by-case basis. Here’s what we consider when we decide:

Whether we need it to operate or provide our products, and services.
We consider the particular data, why it was provided and the likelihood of usefulness in connection with that purpose in the future.

4. Your rights to access, delete or update your data

The California Consumer Privacy Act of 2018 provides that consumers have certain rights when their data is held by a business covered by the CCPA, as amended (“CCPA”). These rights include:

The right to delete personal information collected from them (with some exceptions);

The right to non-discrimination for exercising their CCPA rights.

We are not located in California and we are expressly reserving our right not to comply with California law, however, without assuming any obligation to comply with the CCPA, we do endeavor to provide a methodology for Our Users to exercise these same rights, in general. The Texas Data Privacy and Security Act (TDPSA) of 2023 provides similar rights to the CCPA above which you may exercise. Presently, we do not sell any personally identifiable information. We reserve the right to do so in the future and in such event we will offer you the opportunity to opt out of such sale at that time. You will not be discriminated against for the exercise of any of these rights.

The security of your personal information is important to us. Information that you submit in relation to a financial transaction is encrypted using secure socket layer technology (SSL). Information in our possession is maintained according to generally accepted industry standards. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

In some instances, if you visit these links and/or make a purchase we may receive a small token of compensation. We do not directly endorse particular hotels on the Service, but in the event that we do so any such commercial affiliation or sponsorship will be disclosed clearly and conspicuously. However, once you have used these links to leave our Services, you should note that we do not have any control over other websites or apps. Please be aware that we are not responsible for the content or privacy practices of such other websites or apps, and we encourage you to be aware when you leave our Services and to read the privacy statements of any other website or app that collects personal information.

We are concerned about the safety of children on the Internet but this site is not directed at children. We want you and your family to be safe while visiting our Services. Please note that our Services are not designed for children but can be appropriate in some instances with proper parental supervision. We do not offer any specific program for participation by children under the age of 13. We do not knowingly request or collect information about children under the age of 13 through the Services. If we learn that someone under 13 has provided personal information through our Services, we will use reasonable efforts to remove that information from our systems.
